Common Forms of Distracted Driving in New York City
Distracted driving is a broad term that includes anything that takes a driver’s hands, eyes or concentration off of the road. Statistics tell us that some form of distracted driving plays a role in 16 percent of fatal crashes. In the State of New York alone, distracted driving contributed to one out of every five accidents in 2010, causing 141 fatalities and 25,000 personal injury accidents.
Historically, the most common driver distractions were things such as talking to passengers in the car, eating while driving, grooming, changing the radio station and sightseeing or rubbernecking. A new hazard has emerged in recent years — cell phones and other electronic devices like GPS navigation systems.
Cell phone use has skyrocketed in the last decade. Talking on a cell phone creates a serious danger on the road. However, texting while driving is even more dangerous. Sending or receiving a text message takes a driver’s eyes off of the road for an average of 4.6 seconds. In order to put that in perspective, that amounts to driving the length of a football field at highway speeds completely blind. Experts believe that texting while driving is so dangerous that they have equated it to drinking and driving.
To test that contention, the editors at Car and Driver did their own experiment to compare the impact of texting while driving to that of drunk driving on a driver’s reaction time. Two vehicles were rigged with a red light on the dash that would light up when the driver needed to stop. An editor and an intern then ran the course to provide a baseline reaction time free from distractions. The pair then drove the course again while reading and sending a text as well as after consuming enough alcohol to reach a blood-alcohol level of 0.08 percent. Both drivers’ reaction times were significantly worse when texting than when at the legal limit for drinking and driving.
New York has banned the use of all handheld devices while driving, including texting devices. Despite this ban, drivers continue to use their cell phones to talk and communicate by text messaging while driving, putting everyone on the road at risk.
The New York City distracted driving accident lawyers at David Resnick & Associates, P.C., are experienced at investigating and analyzing car accident cases to look for contributing factors such as distracted driving. Even if the other driver was not charged with violating the cell phone or texting ban, evidence of distracted driving could still be decisive in determining fault. If another driver involved in the accident was driving while distracted, that may lead to a finding of negligence, which may then entitle you to compensation for your injuries.
