Slip & Fall Accident Brain Injury Attorneys in New York City

In Need of a Slip & Fall Accident Brain Injury Lawyer in New York City?

Slip and fall accidents can lead to serious brain injuries, often called traumatic brain injuries (TBI). The most serious brain injuries caused by falls can lead to lifelong disability or an untimely death.

If someone slips or trips and falls and is injured on someone else’s property, the property owner may be held liable for the injury and its costs. Premises liability law holds that property owners must ensure that their properties are reasonably safe for those who visit. This may mean that a property owner or those managing it for the owner must clean up spills or repair broken walkways that could cause someone to slip or trip and fall. Otherwise, they may be held liable for resulting common injuries from slip and fall accidents.

The experienced lawyers of David Resnick & Associates, P.C., can help you get full and fair compensation if you suffered a brain injury in a slip and fall accident in New York City. We can determine whether liability exists in your case and help you recover damages for lost wages, medical bills, and pain and suffering.

The Costs of TBI in Fall Accidents

A brain injury suffered in a slip and fall accident is likely to be an expensive, if not deadly, medical problem. Each year, TBIs contribute to a substantial number of deaths and cases of permanent disability, the Centers for Disease Control and Prevention (CDC) says.

The CDC says direct medical costs and indirect costs, such as lost productivity, from TBI totaled an estimated $76.5 billion in the United States in 2000. The lifetime cost of care for a person disabled by a severe TBI can easily run into millions of dollars.

There are several levels of brain injury that may occur in a fall. A TBI happens when the person falling suffers a blow or sudden jolt to the head, which causes the brain to move within the skull and become bruised or torn.

A brain injury caused by slipping, falling and hitting the head may manifest as:

  • Concussion – This is usually a milder brain injury that may include a headache and temporary loss of consciousness. Some concussion victims have problems with concentration, memory, judgment, balance and coordination. Patients usually recover fully with rest, but an initial concussion leaves individuals more susceptible to brain injury should they hit their head again.
  • Post-concussion syndrome – In some patients, concussion symptoms persist for months or even a year or more. This is known as post-concussion syndrome, or PCS. In addition to concussion symptom, a PCS victim may experience anxiety and depression over their lingering medical problems.
  • Traumatic brain injury (TBI) – While any brain injury caused by trauma is technically a TBI, the term is often used to describe a severe injury that causes lasting brain damage. Severe TBI can include nerve damage, loss of cognitive function (judgment, memory, learning), problems with communication, changes in behavior, emotional problems (mood swings, depression, outbursts), and sensory problems. The very worst cases include coma and degenerative brain disease, which may lead to death.

TBI can also cause epilepsy and increase the risk for conditions such as Alzheimer’s disease, Parkinson’s disease, and other brain disorders that become more prevalent with age, the CDC says.

Anyone who suffers a blow to the head in a fall should see a doctor as soon as possible. Even a mild concussion may develop into more serious problems if not treated. Bleeding in the brain caused by a blow to the head can be fatal if not diagnosed and treated.

In many slip and fall accidents in New York City, some person or entity is responsible for the accident, usually through some form of negligence. This includes, for example, store owners who fail to clean up spills in a timely manner or a property owner who waits too long to clear ice and snow from a sidewalk.

Building owners who fail to properly maintain stairways may be responsible if someone trips on a loose tread or because of a lack of lighting and falls and suffers a brain injury. The breach of a property owner’s duty of care to visitors can lead to them being held liable and ordered to pay monetary damages to the accident victim.
