NEW YORK – David Resnick & Associates, P.C., a personal injury law firm serving clients throughout New York City, announced today that trial attorney Philip Monier has obtained a $2,500,000 pre-trial settlement on behalf of a Bronx woman who suffered catastrophic injuries when a commercial vehicle struck the vehicle she was driving.

The law firm filed the lawsuit in the Supreme Court of the State of New York, Bronx County, demanding compensation for serious injuries the 43-year-old woman suffered in the truck crash. Those injuries included a neck injury requiring surgery to replace a disk with an implant, surgery on her right finger, scar revision procedures, and multiple interventional pain management procedures.
The woman also suffered herniations and protrusions at multiple levels of her spine, along with nerve damage, leaving her permanently disabled and unable to work, according to the federal government, the law firm stated.
Before the accident, the woman worked as an occupational therapy assistant. The physically demanding job required her to help patients with balance and strengthening exercises and lift some patients weighing 200 pounds or more. Her injuries also limited her ability to complete daily activities that most people take for granted, including walking, bending, lifting, sitting, driving long distances, sleeping comfortably, and handling household chores, the firm stated.
“The physical toll of the crash was devastating, requiring our client to undergo major surgical intervention and face an incredibly challenging road to recovery,” Mr. Monier said.
According to the law firm, the defense was prepared to argue that the woman’s injuries were pre-existing and not caused by the crash, and she was not disabled or impaired because any injuries stemming from the accident had fully healed.
David Resnick & Associates, P.C., was prepared to argue that the accident was a substantial factor in causing the woman’s injuries and that, even if any condition existed before the crash, it had been made worse by the collision. The firm also was prepared to show that the woman remained permanently disabled and would need ongoing treatment and future surgical care.
