New York City Taxi Safety Rules

A number of laws in New York, including those found in Section 4-11 of the New York City Department of Transportation’s Traffic Rules, are designed to protect taxi passengers.

For example:

  • Taxis picking up or dropping off passengers must be parallel to the curb and within 12 inches of it.
  • Taxis may not pick up or discharge passengers in crosswalks, intersections, bike lanes or opposite street excavations.
  • Passengers must get out of taxis at the curbside.

All of these rules are intended to ensure that passengers are not put into harm’s way when they exit a taxicab. Taxi drivers are also expected to obey all of the other rules of the road. This includes yielding when required, obeying speed limits, refraining from texting or talking on a handheld cell phone and obeying all traffic signals.

When a taxi driver breaks any of the rules of the road or drives in a careless or unsafe manner, the passengers in the cab are at risk. Drivers of other cars, pedestrians, motorcycle riders and bicycle riders are also in danger if a taxi driver is negligent.

Legal Responsibility for Taxi Accidents

A taxi driver that is negligent or careless behind the wheel or breaks any traffic safety laws can be held legally responsible for an accident that he or she causes. A taxi driver may be sued by passengers, pedestrians, occupants of other cars or anyone else injured in an accident caused by the taxi driver.

Taxi drivers are often employed by taxi companies. When taxi drivers are at work, they are acting as agents of the company that employs them.
