Who's responsible for that?\n\nDavid Resnick: We've had people who have tripped and fallen in front of sidewalks in front of single-family homes, but it's right in front of the driveway of whoever owns the home. Sometimes you can tell that the sidewalk defect\u2014the thing that caused the fall\u2014was caused or created by the homeowner by constantly driving over that portion of the sidewalk to get to their driveway.\n\nAnd if they've done that and you can prove that, you can prove that the homeowner caused or created the problem with the sidewalk or the defect in the sidewalk that caused your injury, then you can make the single-family, two-family, or three-family homeowner responsible for your accident.\n\nDavid Resnick: If it's just a couple of inches away from that driveway, the city becomes responsible. The city is responsible for maintaining sidewalks in front of all single, two, and three-family homes.\n\nDavid Resnick: We've had clients trip and fall on a sidewalk defect that are literally in front of nothing\u2014they're in front of a vacant lot. We've got to do an investigation and figure out who owns that property.\n\nThe owner of that property, even if they don't build anything on it, they are responsible for keeping the sidewalk around their property in a reasonably safe condition and making it smooth so that you don't get snagged on a raised piece of sidewalk.\n\nDavid Resnick: If you get into any type of accident in front of a building, whether it's a slip and fall or a trip and fall, the best thing you can do right away is take photographs of what caused you to fall.\n\nVery often, especially if it's a snow or ice case, that snow or ice is going to be gone by the time you go back three or four days later to take a photo. And every once in a while, after someone falls, someone might go out and fix the sidewalk the next day, and therefore the opportunity to take photos of what caused you to fall has gone.\n\nMy name is David Resnick.
