New York City Pedestrian Rules

Section 4-04 of the New York City DOT Traffic Rules sets out the main regulations regarding pedestrians on city streets. Here are some highlights:

  • NYC motorists must use due care to avoid collisions with pedestrians.
  • Pedestrians in New York City must obey all traffic control signals, pedestrian control signals and signs, as well as the lawful orders and directions of law enforcement officers.
  • When an intersection lacks traffic control signals or pedestrian control signals, drivers must yield to pedestrians crossing a roadway within a crosswalk when the pedestrian is in the vehicle’s path and it is approaching closely enough to put the pedestrian in danger.
  • Pedestrians are not allowed to suddenly leave a curb or other safe place and walk into the path of an oncoming vehicle that is so close that it cannot yield.
  • When a vehicle is stopped at a crosswalk to let a pedestrian cross, another vehicle approaching from behind cannot overtake and pass the stopped vehicle.
  • Pedestrians are not allowed to enter or cross a roadway where there are signs, fences, barriers or other devices in place to prohibit or restrict such a crossing.
  • Pedestrians cannot cross any roadway at an intersection except in a crosswalk.
  • Pedestrians must use a crosswalk to cross a roadway on a block that has traffic control signals at both intersections bordering the block.
  • When a pedestrian control signal displays “WALK,” a green hand symbol or a green walking figure, pedestrians facing the signal may cross the roadway in the crosswalk, and vehicular traffic must yield right of way to the pedestrians.
  • When a pedestrian control signal displays a flashing “DON’T WALK,” red hand symbol or red standing figure, pedestrians are warned that there isn’t enough time to cross, and pedestrians must not enter or cross the roadway. Pedestrians already in the roadway must proceed to the nearest safety island or sidewalk. Vehicles must yield to such pedestrians.
  • When a pedestrian control signal displays a steady “DON’T WALK,” red hand symbol or red standing figure, pedestrians must not enter or cross the roadway.
